Terms of Service

The agreement between your gym and us. Written to be read once and understood.

The agreement

These terms apply when you create a GymNexus account or use the service. If you are agreeing on behalf of a gym or company, you confirm you are authorised to do so, and "you" means that business.

Your account

You are responsible for the accounts you create and for what the people using them do. Keep credentials confidential, give each staff member their own login rather than sharing one, and use the roles and permissions to grant only the access each person needs.

Tell us promptly if you believe an account has been compromised.

Your data stays yours

You own the data you put into GymNexus — your members, their plans, payments, attendance and everything else. We claim no ownership of it.

You grant us permission to store and process it for the purpose of providing the service to you: running the system, backing it up, and helping you when you ask for support.

You are responsible for having the right to hold the data you enter, including obtaining your members' consent where the law requires it. Biometric data in particular carries obligations that fall on you as the gym operating the device.

Fees and billing

Pricing is agreed with you directly rather than published, and is set out in the quote or invoice you receive. Fees are payable in advance for the billing period stated there.

If a payment is overdue we will contact you before taking any action that affects your access. We will not delete your data without telling you first and giving you a reasonable opportunity to export it.

We may change our fees, and will give you notice before a change takes effect at your next renewal.

Availability

We work to keep the service available and will give notice of planned maintenance where we reasonably can. We do not guarantee uninterrupted availability, and the service depends on your own internet connection, which is outside our control.

Attached biometric devices record locally and sync when the connection returns, so check-ins captured during an outage are not lost.

Liability

The service is provided as it is. To the extent the law allows, our total liability to you in connection with the service is limited to the fees you paid us in the twelve months before the claim arose.

We are not liable for indirect or consequential loss, or for loss of profit or business, arising from your use of the service.

Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can stop using the service at any time. Contact us and we will help you export your data.

We may suspend or end an account that materially breaches these terms. Except in cases of serious misuse, we will tell you what the problem is and give you a chance to fix it first.

After termination we retain your data for a limited period so it can be recovered if you change your mind, then delete it.

Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising from them.
